Abstract:
Law No. 32 of 2009 on Environmental Protection and Management (PPLH) is the main foundation in national environmental law. However, the dynamics of the global and national environment demand a revision of the law to be more responsive to the challenges of sustainable development. This study aims to examine the extent to which the principles of sustainable development have been integrated into the current PPLH Law and how they should be optimally included in the revision process. The method used is a normative juridical approach with an analysis of legal norms in the PPLH Law, principles of sustainable development according to international law, and national development policies. The results of the study indicate that although Law No. 32/2009 contains several elements of sustainable development, such as the precautionary principle, intergenerational justice, and public participation, its implementation is still fragmentary and less operational. In the upcoming revision, it is necessary to strengthen legal norms that guarantee the integration of economic, social, and environmental principles in a balanced manner, as well as strengthen preventive legal instruments and law enforcement based on scientific and technological data. This revision is expected to make Indonesian environmental law more adaptive, inclusive, and effective in responding to the ecological crisis and supporting the sustainable development agenda.
