Implementation of Environmental Impact Analysis (AMDAL) in the Industrial Area of the North Coast of Java in an Effort to Enforce Environmental Law

Abstract:
The North Coast of Java as an area has been quite dense as a transportation route since the Dutch colonial era. As a fairly dense area, it has led to many activities, ranging from settlements to the economic sector of the community to move there. Starting in the 1960s, many housing estates began to be developed by the community. Besides settlements, many factories began to be built given the potential for easily accessible transportation, and the potential market commodities was the reason for the industrial area to be established. Along with the development of the industrial area, the state had to enforce regulations to control the environmental balance due to development, and the development system must have an Environmental Impact Analysis (AMDAL) as the first capital. This writing uses a normative juridical method by analyzing applicable regulations whether they have been running according to the provisions or they are facing obstacles. The analysis is developed through other literature sources in the form of books, journals, and articles that are relevant to the theme of the writing. AMDAL is essentially a refinement of a development project planning process. The negative impacts that are often caused by development projects can be minimized with AMDAL. Efforts can be made to realize this by carrying out environmentally conscious development, considering the environment from the start of the development planning until the development operation. During the development in Indonesia, many weaknesses of AMDAL have been identified such as the lack of integrity of the development agreement, lack of community involvement in the development process, and implementation that is not in accordance with the planning.
