Maslahah's Perspective on Reto Tuo Practices in the Lebak Indigenous Community

Abstract:
This study examined the practice of reto tuo in the Lebak Indigenous Community which has successfully improved the welfare of their heirs’ descendants. However, the absence of clear regulations regarding reto tuo has the potential to lead to disputes among them. The research focused on the Maslahah perspective on the practice of reto tuo. It concluded that reto tuo, as a form of family waqf in the Lebak Indigenous Community, involves the shared use of undivided inheritance assets. Reto tuo was managed by one child, chosen by the parents during their lifetime or agreed upon by the heirs. This practice provided welfare for the descendants, served as a moral message to preserve assets for the well-being of future generations, strengthened family ties, and reflected the parents’ affection toward their descendants. However, it also carried the risk of harm due to unclear ownership and the potential for conflict arising from unilateral use by the appointed heir, particularly given the lack of specific regulations.
