Abstract:
Coercion occurs as a result of sexual relations between husband and wife or vice versa. This is not allowed in Islamic teachings because the fulfillment of spiritual needs in a marriage is prioritized through mutual willingness and sincerity. The aim of this study is to analyze Act 23 of 2004 concerning the Elimination of Domestic Violence Article 8 from the perspective of Mubadalah studies and its implication on the harmony of families. This study is analytical-descriptive and used a qualitative method through library research, which is a data collection method that studies theories from various literature related to the topic. The results of this study found that Article 8 applies to not only to the husband but also to the wife. Thus, it concludes that this Act is in accordance with the principle of mubadalah, which is the principle of mutuality and includes all values of equality and humanity. The perspective of Mubadalah states that men and women are equal subjects whose relationship is based on cooperation, mutuality, and mutual assistance. Article 8 can also have implications for the realization of a harmonious family because it encourages the establishment of a good relationship between husband and wife, healthy marital intimacy, educated children, fulfilled needs, establishment of good community life, and increased faith.
